David Lively is a member of the Litigation department. He joined Hopkins & Carley in 2005.

Mr. Lively’s areas of practice include construction, real estate, commercial litigation and transactions.  He has been lead trial counsel in  over 100 civil trials and binding arbitrations.  He has also been appellate counsel in numerous appellate cases, and several published opinions.

As he describes his practice, "I help clients, whatever their needs.  These range from relatively small matters to difficult, multi-million dollar litigation. My objective is to help clients grow their businesses, particularly ones that are small to medium-size and closely-held."

Mr. Lively received his Juris Doctor degree from Santa Clara University, cum laude, in 1978; he received his bachelor’s degree in history, cum laude, from the University of Colorado in 1975.  He was admitted to the State Bar of California in 1978, and is admitted to practice law in the U.S. District Court for the Northern and Central Districts of California.  Mr. Lively is a member of the Santa Clara County Bar Association.

Prior to joining Hopkins & Carley, Mr. Lively, was a founding partner in the firm of Olimpia, Whelan & Lively from 1986 to 2005.  While there, his primary areas of practice were construction, real estate, commercial litigation and transactions.
